Information that CRISP & GREEN^® Collects

CRISP & GREEN^® only obtains personally identifiable information such as your name, email address and payment card or other information when you provide it voluntarily. For example, personal information may be collected from you to:

respond to your comments regarding a CRISP & GREEN^® restaurant, our websites, or other aspects of CRISP & GREEN^®;
register you for our mailing lists or as a user of online or mobile products or services we offer, or to register you for promotions or offers conducted through our websites or mobile campaigns;
transmit payment information for online or mobile orders;
respond to job inquiries and job applications submitted by you; and
respond to other information submitted by you to any of our websites or through any of our mobile campaigns.

This information will be used for the purposes for which you provide it. We may also use this information to communicate with you from time to time for other purposes, such as to create personalized promotions by combining your personal information with non-personal information about you, such as the amounts and types of purchases you make or any benefits you receive through our programs. We may also use the information you provide us for additional purposes as described under “Sharing of Personal Information.”

In addition to personally identifiable information about you, CRISP & GREEN^® may collect aggregated data or anonymized data that does not directly identify you. For example, we may automatically collect website use information, such as information about your Internet service provider, your operating system, browser type, domain name, Internet protocol (IP) address, your access times, the website that referred you to us, the Web pages you request, and the date and time of those requests.

Cookies that CRISP & GREEN^® Stores

We use cookies for a variety of purposes to improve your visits to our websites. Cookies are pieces of information that a website transfers to the hard drive on your computer for record-keeping purposes. These cookies will allow the website to remember important information that will make your use of the website more convenient. For example, we track the total number of visitors to our websites on an anonymous aggregate basis. We also use cookies so that we remember you when you return to our websites.

CRISP & GREEN^® uses its best efforts to protect your personally-identifiable information and privacy. We do not sell, transfer or disclose your personal information to any third parties other than for the limited purposes described in this policy.

With your permission, we will send marketing information to you, such as promotional offers or information about new product offerings, programs or restaurant openings. If you do not want to receive this stuff, you can contact us to opt out and we will not send it to you thereafter. Also with your permission, we may occasionally send marketing information to you on behalf of one of our business partners. On our websites, in our restaurants, or elsewhere, we may ask if you want to receive marketing materials from our business partners. If you want to receive this stuff, we’ll send it to you… if you don’t want it, just tell us and you won’t get it. But remember, CRISP & GREEN^® will not share your personal information with any of its business partners. We will just send a mailing, e-mail, text message or similar communication on behalf of the business partner.

CRISP & GREEN^® sometimes contacts other companies for a variety of reasons, such as fulfilling orders, assisting with promotions, and providing technical services for our websites. These companies may have access to personal information if they need it to do their work. However, we will generally obligate these companies to use any personal information only for the purpose of performing their work.

We may, where expressly stated, post certain submissions on our websites. However, we will not include your full name or other personal information identifying you unless you have given us consent to do so

We keep your job inquiries and job applications confidential. However, we may share personal information within our affiliated companies for purposes of evaluating you as a candidate for any openings.

CRISP & GREEN^® does reserve the right to use or disclose any information as needed to satisfy any law, regulation or legal request, to fulfill your requests, or to cooperate in any law enforcement or similar investigation.

Finally, we may also share aggregated or anonymized information that does not directly identify you.

CRISP & GREEN’S^® Privacy Policy in Regards to Children

CRISP & GREEN does not intend our websites to collect personal information from kids under the age of 13.

We urge parents to regularly monitor and supervise their children’s online activities. Although our website is not intended to collect personal information from kids under the age of 13, to review any personal information that your child may have submitted to CRISP & GREEN^®, to ask us to delete that information or to stop further use of the information, please submit this information on our contact page.

Crisp & Green Loyalty Program

Introduction

The CRISP & GREEN® Rewards Program (“Program”) is a United States loyalty program offered at the sole discretion of CRISP & GREEN LLC, hereinafter referred to as “Us,” “We” or “Our,” at CRISP & GREEN locations throughout the United States (“CRISP & GREEN Restaurant(s)”).

At Our sole discretion, We have the right to modify, add or delete all or any portion of the Program rules, terms, conditions, benefits or rewards, at any time, with or without notice, even though such changes may affect the value of points already accumulated, the value of the rewards and/or the time for redemption.

Membership and Eligibility

You can sign up to be a Program participant (“Participant” or “you”) by downloading the CRISP & GREEN digital application (the “Application”) on the Apple App Store or Google App Store, or at our website at crispandgreen.com/rewards (the “Website”); and registering and setting up an account (an “Account”).

Participants must:

(a) Be at least thirteen (13) years of age;

(b) Be a resident of the United States (including United States territories); and,

Each Participant may only have one Account within the Application and with which it participates with the Program.

Additionally, by participating in the Program, a Participant acknowledges that he/she agrees to CRISP & GREEN’s Privacy Policy and Terms of Use, which can be viewed at crispandgreen.com/terms-privacy.

Earning Points

In order to earn points (“Points”) that can be applied towards a reward (“Reward”), a Participant must identify himself/herself as a Participant by utilizing the Application or providing their reward Account information each time the Participant makes a purchase in a CRISP & GREEN Restaurant or when ordering online or digitally. Participants may also open the Application or Website and scan the barcode located on their receipt within three (3) days of a Qualifying Purchase and follow the directions.

Participants will earn 1 point for every $1 of Qualified Purchases (defined below) made at or from a CRISP & GREEN Restaurant and using the Application at the time of purchase.

“Qualified Purchases” are merchandise purchases at or from a CRISP & GREEN Restaurant, excluding sales tax, tips, fees and shipping, Reward redemption, purchases made prior to enrollment, gift cards, returned merchandise, refunds, online services, service items, warranties, and gift certificates.

We will not be liable for the failure of any Points to be captured or recorded for any reason, including without limitation due to any failure of the Website or Application, and/or any technical malfunction or other problems relating to the telephone network or lines, computer systems, servers, access providers, computer equipment or software.

Redeeming Rewards

Your Account will display available Rewards that you are available to redeem your Points to obtain. Once you redeem an offer for a Reward within your Account, the Points will be deducted from your Account and you will have approximately four (4) hours to use your Reward. If you do not use it within this four (4) hour period, the Reward will expire and the Points you redeemed will be deposited back into your Account. A Reward can only be redeemed in one transaction.

Points and Rewards cannot be redeemed for gift cards, gift certificates, store credit, sales tax, prior purchases, and neither Points nor Rewards have any value outside of the Program. Points and Rewards have no cash value and neither cash nor store credit will be paid for unused portions of the Reward. Points and Rewards are not transferable and Participants can only redeem Rewards associated with that Participant’s account. Participants must redeem Points prior to their expiration date and Rewards as stated. The Program reserves the right to change the Rewards expiration date at any time without prior notification. The accumulation of Rewards and/or Points does not entitle a Participation to any vested rights, and We do not guarantee in any way the continued availability of any Reward or validity of any Points.

All Points and Rewards are subject to verification at any time for any reason. We reserve the right, in our sole and absolute discretion, to invalidate any Rewards we deem to have been awarded in error, or as the result of any fraudulent or dishonest activity, or any activity not in keeping with the letter and/or spirit of these Terms and Conditions, as interpreted by us in our sole and absolute discretion. Any Rewards that cannot be verified to Our satisfaction are subject to forfeiture or cancellation.

All costs, fees and expenses incurred by a Participant in redeeming a Reward and using the Reward are the full and sole responsibility of the Participant. Each Participant is fully and solely responsible for any and all income and local, state, provincial and deferral taxes on any Reward they receive.

Point Expiration

All Points expire 365 days after the date upon which the Points were earned or at any other time as We may establish. In addition, any Points will be immediately forfeited if your membership is revoked as provided in these Terms and Conditions.

Welcome Reward

New Participants will receive a non-transferable Welcome Reward good for $5 off of a Qualified Purchase of $20 or more. The Welcome Reward will expire 30 days after the date of issuance. The Welcome Reward cannot be combined with any other rewards or discounts. The Welcome Reward has no cash value, and if the entire Reward is not used on a single check, the remainder of the Welcome Reward is forfeited. No cash back will be paid on any Reward (unless otherwise required by law). All other terms applicable to Rewards herein apply to the Welcome Reward.

Birthday Reward

The Birthday Reward is offered to those Participants who provide their birthday and opted-in to receive promotional marketing communications from us via text message or email and have validated their phone number. The Birthday Reward is valid for one complimentary Smoothie Menu Item within thirty (30) days of the birthday of the Participant. The Birthday Reward cannot be combined with any other offers or discounts. The Birthday Reward is non-transferable, unique to each active Participation, and must be validated by account authentication at the time of purchase. All other terms applicable to Rewards herein apply to the Birthday Reward.

Change in Account Information

Participants are responsible for notifying Us of any changes to their information, including mailing address and e-mail address. Our Restaurants are not responsible for Rewards that are lost, delayed or misdirected digitally, in the mail, by email or otherwise. Account information changes can be made by logging into the Website or in the Application.

Program End

The Program has no predetermined termination date and may continue until such time as CRISP & GREEN Restaurants, in Our sole discretion, elect to designate a termination date. Our Restaurants reserve the right to modify or end the Program, or any part of the Program, at any time without providing written notice to you.

Abuse of the Program (for example, by a Participant failing to follow the Terms and Conditions, allowing others to use the Participant’s membership number or other improper conduct as determined by CRISP & GREEN Restaurants (in Our sole discretion) may result in termination of that Participant’s membership and disqualify that Participant from future Program participation. We reserve the right, in our sole discretion, to de-activate/cancel your account and/or cancel any or all Rewards and/or Points you may have earned under the circumstances otherwise described in these Terms and Conditions.

You may cancel your Program membership and Account at any time by accessing your Account and deactivating or deleting your account, or by:

in each case explaining that you wish to cancel. As soon as you cancel your Participation, We will de-activate your account and you will forfeit any Rewards and Points that you may have earned. Upon the death or personal bankruptcy of a Participant, that Participant’s Account will be closed and any Points and Rewards in the Account will be forfeited. Points and Rewards are not divisible in the case of divorce.

Additional Terms

Modification of the Terms and Conditions may only be made in writing by an authorized representative of Our Restaurants. All interpretations of the Terms and Conditions will be at the sole discretion of Us and such interpretations are binding on Participants. Points and Rewards may be subject to federal, state, or other taxes and such taxes are the sole responsibility of the respective Participant.

The Program participation and its benefits are offered at the sole discretion of Us. Using the Program constitutes the participant’s agreement to the Terms and Conditions of the Program. At its sole discretion, We have the right to modify, add or delete any of the Rewards Program rules, terms, conditions, benefits or rewards, in whole or in part, at any time, with or without notice, even though such changes may affect the value of Points already accumulated, the value of the rewards and/or the time for redemption. The Program is a United States program. The laws of the State of Minnesota apply to the Program and these Terms and Conditions without regard to any conflict of law rules that may require the application of the laws of another jurisdiction. If in any particular state the Program or CRISP & GREEN Restaurants have to apply for any special license, bonding, permit or other governmental regulatory approval, the Program will be void in that particular state. Participation in the Program is void if prohibited by law in the jurisdiction in which the prospective Participant resides.

Keeping in Touch With You

As a part of the Program, We may send you informational marketing, and promotional materials and other Program-related communications to the contact information you have provided as part of your registration. These may include, for example, messages informing you of improvements we make to the Program, new Rewards you may earn, Rewards you have earned that may be ready to expire, new menu items you may want to try, events happening in Restaurants, and other related information. If you change any of your Account contact information after joining the Program, you agree that We may continue to send you marketing and/or promotional or transactional messages to the new contact information.

Marketing and Promotional Communications

By participating in the Program, you acknowledge and agree that eligibility for some Rewards requires you to opt-in to receive marketing and/or promotional communications through e-mail, text message, and/or push notifications through the Application.

If you no longer wish to receive such marketing and/or promotional communications, you may unsubscribe or opt-out at any time by updating your communication preferences through your Account dashboard or Application settings or by following the instructions contained in the individual marketing and/or promotional message. Please note, opting out of receiving marketing and/or promotional communications may change your available Rewards and you will no longer be eligible for select Rewards.

NOTE: Regardless of your Account preferences or opt-in status, we may still send you transactional communications relating to your participation in the Program (e.g., account-specific administrative, status, and service announcements), and by participating in the Program you acknowledge and agree that such communications are allowable.

Limitation of Liability

By registering for and/or participating in the Program, you agree that, to the fullest extent permitted by law, We and our parents, subsidiaries, affiliates, franchisees, and its and their respective directors, officers, shareholders, employees, agents, contractors, and representatives (collectively, the “CRISP & GREEN Parties”) shall not be liable to you for: (1) any claim, loss, injury, damage, delay, accident, cost or expense, including legal fees, arising out of or related to the Program, Rewards, these Terms and Conditions, or the Website or Application; (2) any incidental, indirect, special, punitive, exemplary or consequential damages arising out of or related to the Program, Rewards, these Terms and Conditions, or the Website or Application; (3) any failure, delay or decision by any of the CRISP & GREEN Parties in administering the Program; (4) any use of your Account by a party that you did not authorize to use your Account; (5) any representation, claim, offer or statement we make about the Program; and/or (6) your use and acceptance of any Points Rewards you receive through the Program. You further agree that in no event will the CRISP & GREEN Parties be liable to you for more than $50 (US) in the aggregate for all wrongful acts or omissions by the CRISP & GREEN Parties arising out of or relating to the Program, Rewards, these Terms and Conditions, or the Website or Application. To the fullest extent permitted under applicable law, you agree that notice of any claim must be given within two years of its accrual or such claim is waived and time barred.

Entire Agreement

These Terms and Conditions and the other terms incorporated by reference into Terms and Conditions, constitute the entire agreement between the CRISP & GREEN Parties and you and set out all of the covenants, promises, warranties, representations, conditions, and agreements between us in connection with the Program and supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written, pre-contractual or otherwise. There are no covenants, promises, warranties, representations, conditions or other agreements, whether oral or written, pre-contractual or otherwise, express, implied or collateral, whether statutory or otherwise, between us in connection with the Program except as specifically set forth in these Terms and Conditions.

Contest Terms and Conditions

ELIGIBILITY: Crisp & Green Holiday Promo (the “Contest”) is open to entrants ages 18 and up that are Crisp & Green loyalty members and who qualify under these Official Rules. All employees of Crisp & Green LLC and its affiliates (collectively, “Sponsor Entities”) and their immediate family members (spouse, parent, child, sibling and their respective spouses), are ineligible to participate in the Contest. All applicable federal, state and local laws and regulations apply. Void where prohibited or restricted by law. Entry in the Contest constitutes your full and unconditional acceptance of these Official Rules.

CONTEST PERIOD: The Contest entry period begins at 12:01 a.m. CDT on November 18, 2025 and ends at 11:59 p.m. CDT on December 31, 2025 (the “Contest Period”). Finalists will be selected from entries properly submitted and received during the Contest Period.</span<

CONTEST ENTRY INSTRUCTIONS: To enter, during the Contest Period, participants must both be a registered loyalty member as required by Crisp & Green electronic applications, and must show their loyalty account upon check-out when they purchase a Crisp & Green gift card during the Contest Period. Limit one entry per gift card purchased. Sponsor is not responsible for lost, misdirected, or delayed entries. The odds of winning depend on the number of eligible entries received.

ALTERNATIVE MEANS OF ENTRY: NO PURCHASE NECESSARY. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. You may also enter the Contest by mailing a standard-size envelope including your name, address, email address, to: Crisp & Green Holiday Promo, 301 Broadway Ave S, Wayzata, MN 55391. Mailed entries must be received during the Contest Period to be included, and no more than one mailed entry/email address/household per entrant may be submitted during the Contest Period.

HOW A WINNER WILL BE DETERMINED: The five grand prize winners (“Grand Prize Winner”) will be selected based a random drawing on January 5, 2025.

PRIZES: The Grand Prize Winners will receive (the “Grand Prize”) of a $100 Crisp & Green gift card. The Grand Prize Winners will be contacted on January 5, 2025 via the phone number provided on their loyalty account, and will have until January 12, 2025 to claim the Grand Prize.

PUBLICITY/OWNERSHIP: As a condition of entry into the Contest, except where prohibited by law, each entrant consents to the use of their name, city, state, biographical information, and likeness in connection with the Contest in any media worldwide without additional compensation. Where necessary, any prize winner may be required to execute and return an Affidavit of Eligibility/Liability and Publicity Release within five (5) business days of attempted notification. Any winner may be disqualified and an alternate winner selected, in Sponsor’s discretion, if the winner is unresponsive or communication with the winner is returned as undeliverable.

GENERAL RULES: By entering, participants agree to these Official Rules and the Sponsor’s decisions, which are final. The Sponsor may cancel, modify, or suspend the Contest for technical issues, fraud, or any factors beyond its control. Entries using automated methods or violating these rules will be disqualified. The Sponsor Entities are not responsible for claims, losses, or damages arising from participation or prize use.

PARTICIPANT OBLIGATIONS: By participating in the Contest you agree to be bound by these Official Rules and the decisions of Sponsor and indemnify and hold harmless the Sponsor Entities from any third-party claims. By accepting a prize, winners release the Sponsor Entities from any liability arising out of participation or prize use.

PERSONAL INFORMATION: The personal information collected through the Contest is subject to the Crisp & Green Privacy Policy and may be used for additional marketing and other communications.

RULES/WINNERS’ LIST REQUESTS: To obtain a copy of these Official Rules or for notification of the winners, send a self-addressed stamped envelope to: Crisp & Green Holiday Promo, 301 Broadway Ave S, Wayzata, MN 55391. Requests for winners’ lists must be received within one (1) month after the end of the Contest Period.

DISPUTES / GOVERNING LAW: Any disputes that may arise hereunder shall be governed in all respects by the laws of Minnesota without regard to the conflicts of laws principles of any jurisdiction. Venue with respect to any such disputes shall be had in the courts of Hennepin County, Minnesota. Any and all disputes, claims, and causes of action arising out of or in connection with this Promotion, shall be resolved individually, without resort to any form of class action ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS PROMOTION. YOU (AND YOUR PARENTS OR LEGAL GUARDIANS IF YOU ARE A MINOR) HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, IDENTIFIABLE PERSONS, OR THIRD PARTY PARTICIPANTS, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
